This privacy policy describes the personal information Winks (“Winks”, “We” or “Us”) collects and how that information may be used, with whom it may be shared, as well as your choices regarding that information collection and disclosure. By using our application or website (our “Service”) you are accepting the practices described in this Privacy Policy.

Information we Collect

We collect information you provide. In order to use Winks, you will be asked to sign in using Facebook Login. By logging in with Facebook, you authorize Winks to access certain Facebook account information, all of which are controlled by your Facebook privacy settings. You will be asked for this authorization during Facebook login. The information we receive from Facebook include your public Facebook profile (contains basic information such as your Facebook name, first name, last name, Facebook id, Facebook username, Facebook profile link, Facebook profile picture) and optionally your email address, gender, birthday, education history, work, current city and hometown. You can also authorize Winks to provide access to your public Instagram profile by providing us with your Instagram username when you use the application. Also, you can also authorize Winks to display your Snapchat username by providing us with it. In addition, you will be asked to authorize Winks to collect your geographic location information while our application is running in the foreground as well as when it runs in the background in your mobile device. We will also collect any personal information you provide while using our application like photos you upload.

When you use our Service, some information is automatically collected. This may include information like the Operating System (OS) running on your device, Internet Protocol (IP) address, device ID and type, access times, browser type and language and the referring website address.

We automatically collect information using technologies like “cookies” and Web beacons. Cookies are small data files stored on your hard drive by a website and web beacons are electronic images that may be used on our Service. Among other things, cookies help us improve our Service, our marketing activities, and your experience. We use cookies to see which areas and features are popular and to count visits to our Service. Most web browsers are set to accept cookies by default. If you prefer, you can choose to set your browser to remove cookies and to reject cookies. If you choose to remove cookies or reject cookies, this could affect certain features of our Service.

How we use information we collect

We may use the information we collect about you to:

  • Deliver and improve our product and Service and manage our business;
  • Understand and enhance your experience using our Service;
  • Provide and deliver products and services you request;
  • Respond to your comments or questions regarding our Service;
  • Website or mobile application analytics;
  • Communicate with you about promotions, upcoming events and news about products and services offered by Winks and our partners;
  • Develop, display and track content and advertising tailored to your interests; and
  • Protect, investigate and deter against fraudulent, unauthorized or illegal activity.

Winks may perform these functions directly or use a third party vendor to perform these functions on our behalf who will be obligated to use your personal information only to perform services for us.

Sharing of personal information

  • Information shared with other users. When you register for Winks, your Winks profile will be viewable with other Winks users. Other users will be able to view information you have provided to us directly or through Facebook such as your first name, age, gender, zodiac sign, work, education history, current city, hometown, the Facebook profile picture, a link to your Facebook profile, a link to your Instagram profile if you have provided us with your Instagram username and your Snapchat username if you have provided us with it. Winks may also display your approximate geographic location in its Map feature. If you choose to interact with another Winks user by “winking”, he/she will be notified about that.
  • Personal Information. We do not share your personal information with third parties except as described in this privacy policy without your consent other than:

    • We may share personal information with third parties that perform certain services on our behalf (service providers). These services may include providing customer service, marketing assistance, business and sale analytics, ad tracking and analytics. These parties will be obligated to use your personal information only to perform services for us;
    • To protect the rights and property of Winks, our customers and others including to enforce our agreements, policies and terms of use;
    • To comply with laws or to respond to lawful requests and legal process (provided that Winks will endeavor to notify you if Winks has received a lawful request for your information);
    • In an emergency, including to protect the personal safety of any person; and
    • For the purposes of a business deal (or negotiation of a business deal) involving sale or transfer of all or a part of our business or assets (business deals may include, for example, any merger, financing, acquisition, divestiture or bankruptcy transaction or proceeding).

We may also share aggregate or de-identified information derived from your personal information.

Personal information security

Winks takes reasonable steps to help protect your personal information in an effort to prevent loss, misuse, and unauthorized access, disclosure, alteration and destruction. However, no system can be completely secure. Therefore, although we take steps to secure your information, we do not promise, and you should not expect, that your personal information, chats, or other communications will always remain secure. Users should take care how they handle their personal information and avoid sending sensitive information through insecure email.

Your information choices and changes

If you have a Winks account, you can choose to provide Winks with your Instagram username and thus authorize Winks to display a link to your public Instagram profile to other users. Also, you can provide Winks with your Snapchat username and thus authorize Winks to display it to other users. You can also change/update the Winks profile picture. You can choose not to provide Winks with your location, which will result in you being unable to use basic features of our Service. Moreover, if you choose to remove cookies or reject cookies in your browser, this could affect certain features of our Service. Finally, you can choose to delete your Winks account. By deleting your Winks account, we will retain certain information associated with your account for analytical purposes and recordkeeping integrity, as well as to prevent fraud, enforce our Terms of Use, take actions we deem necessary to protect the integrity of our Service or our users, or take other actions otherwise permitted by law. In addition, if certain information has already been provided to third parties as described in this Privacy Policy, retention of that information will be subject to those third parties' policies.

Children

Although our Service is a general audience Service, we restrict the use of our service to individuals age 13 and above. We do not knowingly collect, maintain, or use personal information from children under the age of 13.

Changes to this policy

Winks may change this Policy from time to time. If we make any changes to this Policy, we will change the "Last Updated" date above. We recommend that you check our Service from time to time to inform yourself of any changes in this Privacy Policy or any of our other policies.
